Croatian Singer Severina Vučković Sued Online Tabloid For Leaking Her Sex Tape

27/08/2003

Severina Vučković, or known by her professional name Severina, is a Croatian pop singer-songwriter and actress.

She was involved in an internationally reported sex scandal after her sex tape with Bosnian Croat businessman Milan Lučić, was leaked to the internet in 2004.

The sex tape was presumably taken in a yacht.

The incident was a scandal because Lučić was married at the time of the shooting, and Severina had previously known as a Catholic believer that condemned extramarital sex, and was still in relationship with Bosnian Croat general Stanko Sopta.

At the time of the tape's release, Severina was reported to be in a relationship with Srećko Vargek.

First reported and leaked by the Croatian online tabloid Index.hr, the sex tape shocked the public.

Severina Vučković sued the website that released the tape for damages, and filed a lawsuit against five people, including the editor, the publisher, and the journalist of the website for the aforementioned criminal offense.

She claimed that the video was stolen from her and that it was her intellectual property.

Severina stated that the suspects had published an author's work for which they had not obtained her approval as a co-author of the work.

The lawsuit however, was later dismissed by a Zagreb district court in July 2004, considering that "in the case of the recording, it is neither a work of authorship nor a performance by an artist."

The Prosecutor's Office explained that in order for the video to be considered an author's work, according to the Croatian law, it must be an original intellectual creation from the literary, health and artistic fields that has an individual character, regardless of the way and form of expression and so on.

The sex tape however, is a recording of an intimate relationship intended for private use only, without the intention of the participants to make it public.

The Prosecutor's Office also clarified that artists are performers, just like actors and actresses, singers, dancers, directors, conductors and others who perform works from the fields of literature, art or folklore.

And in this case, the sex tape is not about the performance of an artist's 'professional' work that can fall within any of these categories.

Severina argued that she was indeed the performing artist in the video and that is indisputable, but that statement was not accepted either.

It's worth noting that despite the lawsuit about intellectual property was dismissed by the court, but violation of privacy was approved, and Severina was compensated 100,000 Croatian kuna.

Having won the award “Zlatna ptica” for the best selling artist of the decade in Croatia, Severina was also the most Googled person in both Coratia and Slovenia in 2015.

After her relationship with Lučić ended following the release of the sex tape to the internet, Severina took a two-year break from the spotlight, before releasing her 8th studio album Severgreen in 2004. This was her first biggest project and public appearance after the scandal.
